4.1 Pricing Plans

Momentum is offered exclusively on a monthly subscription basis. Current plan tiers, pricing, and included credits are communicated through our pricing page, proposals, invoices, or onboarding materials, and may be updated from time to time with reasonable notice.

4.2 Billing & Renewal

Monthly plans renew automatically each month on the anniversary of your subscription start date, until cancelled.

4.3 Refund Policy

You may cancel your monthly subscription at any time. Cancellation stops future billing but does not entitle you to a refund for the current billing period already paid. No partial-month refunds are issued.

4.4 Late Payments

If payment fails, we will notify you and attempt to retry the charge. Access may be suspended after 7 days of a failed payment. If the account remains unpaid for 30 days, it may be terminated.

5.1 Your Brand Content

You retain full ownership of all brand materials you provide. By submitting brand content, you grant Hypeliv a limited, non-exclusive, royalty-free licence to use that content solely for the purpose of delivering the Service, including transmitting it to the third-party AI providers listed in our Privacy Policy for generation purposes.

5.2 AI-Generated Content

Upon your approval and publication of AI-generated posts, ownership of that output is assigned to you, subject to any terms imposed by the underlying AI provider used to generate it (including OpenAI, Replicate, HeyGen, Hedra, ElevenLabs, Sarvam AI, or Anthropic, as applicable) and the respective social media platforms.

5.3 Platform IP

All software, algorithms, interfaces, designs, and systems underlying Momentum are the intellectual property of Hypeliv. You may not copy, reverse-engineer, decompile, or create derivative works based on any part of the Service.

6.1 Service Availability

We aim to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free.

6.2 Content Accuracy

AI-generated content is produced algorithmically and may not always be accurate or on-brand. You are solely responsible for reviewing all content before it is published.

6.3 Limitation of Liability

Except in cases of gross negligence, willful misconduct, or fraud, Hypeliv’s total liability shall not exceed the total fees paid by you in the 3 months immediately preceding the claim. In no event shall Hypeliv be liable for any indirect, incidental, or consequential damages.

7.1 Termination by You

You may cancel your subscription at any time through your account settings, or delete your account entirely using the self-serve account deletion option in your account settings.

7.2 Termination by Hypeliv

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or fail to pay applicable fees.

7.3 Effect of Termination

Disconnecting an individual social media platform (e.g., Instagram) does not delete your account — your account, other connected platforms, and content remain active. Upon disconnecting a specific platform, its access token is invalidated and deleted immediately.

Upon full account deletion, we retain your account data, billing history, and generated content for up to 60 days for recovery purposes, after which it is permanently deleted, except where we are legally required to retain certain records for longer (see our Privacy Policy for details on data retention).
